(a): For improving over all standard of education under Sarva Shiksha Abhiyan 1,86,985 schools have been opened, 8.81 lakh teachers have been recruited through out the country, 1,41,738 school buildings, 5,57,927 additional classrooms constructed,and 1,54,121 drinking water facilities, 1,97,633 toilets provided in schools.

(b): Statement showing increasing trend of Gross Enrolment Ratios at primary level from 2004-05 to 2005-06 is given in Annexure-I.

(a) to (f): State-wise funds provided by Government of India to States/Union Territories and expenditure incurred during the last three years and the current year under Sarva Shiksha Abhiyan (SSA) is given in Annexure-I.Information in respect of allocation of funds made to States/Union Territories in respect of Mid Day Meal (MDM) Scheme is given in Annexure-II.

As a result of implementation of SSA and MDM programmes the out of school children in the age group of 6-14 years have declined from 3.20 crore in 2001 to about 45 lakh by March,2008.

Under Sarva Shiksha Abhiyan several activities have been undertaken to improve the quality of education, which include inter-alia recruitment of teachers to improve the pupil teacher ratio,regular in-service training of teacher every year,free distribution of textbooks at elementary level,regular support to elementary schools through Block and Cluster Resource Centres and periodic independent testing of student achievements levels.

(a) to (d) : Government, vide Press Note 2 (2000 Series) dated 11.2.2000 of the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion) has allowed FDI up to 100% on the automatic route in the Education Sector, subject to the sectoral rules/regulations as may be applicable. At present,only the All India Council for Technical Education (AICTE) has regulations in place for entry and operation of foreign universities/institutions imparting technical education in India.According to available information, four Indian institutions have been accorded approval by AICTE for conducting foreign university programmes in India. The curriculum depends on the agreement between the two collaborating institutions.

A legislative proposal for regulating the entry and operations of foreign educational institutions in India is under consideration of the Government.

(a) to (c): The Budget allocation of the Department of SchoolEducation & Literacy was increased by 21.18% in 2007-08 as compared to 2006-07. In the year 2008-09 budget for elementary education has gone up by 17.01% as compared to 2007-08, as per details given in Annexure.

(d): The percentage utilization of the Budget allocation of the Department in the year 2007-08 has been 99.83%.

(e) to (f): The Sarva Shiksha Abhiyan Programme provides for Universalisation of Elementary Education in a time bound manner to bridge all gender and social category gaps at elementary level and universal retention by 2010.

The Gross Enrolment Ratio (as per Selected Educational Statistics-2005-06 data) has been 109.40 at primary level and 71.15 at upper primary level. Girls enrolment has been 48% of total enrolment at primary level in 2006-07 and 46.5% at upper primary level. Out of school children have reduced from 3.20 crore in 2001- 02 to 0.76 crore as per State Reports, March, 2007. The Gross Enrolment Ratio for Girls has gone up to 105.87% in 2006-07 for primary and 66.50% for upper primary level.

(a) Government has not conducted any study regarding the quality of education imparted in the English medium schools.However, Government of India conducts its own pupil learning achievement surveys under Sarva Shiksha Abhiyan (SSA) through National Council of Educational Research and Training (NCERT). The surveys aim to track changes in learning achievement levels of students and to give a national picture of the status of students` learning levels.

(d) and (e) National Curriculum Framework (NCF) - 2005,lays special emphasis on the primacy of children`s experiences and their active involvement in the process of learning. The enrolment of girls and total enrolment has gone up to 48% at primary level and 46.5% at upper primary level by 2006-07. 6645 muslim minority girls were enrolled in Kasturba Gandhi Balika Vidyalayas in educationally backward blocks upto 31st December, 2007.

(a) & (b) : Ministry of Human Resource and Development is the nodal Ministry for education in general. Ministry of Tribal Affairs only supplements the efforts of the Ministry of HRD. In so far as the Ministry of Tribal Affairs is concerned, it is administering the scheme of Eklavya Model Residential Schools (EMRS) with the objective of providing quality education to the tribal students. It was decided during 1997-98 to utilize a part of the funds under Article 275(1) of the Constitution of India for setting up of 100 Model Residential Schools from Class VI to Class XII in different States.100 schools have been sanctioned to 24 States, and 79 are in operation. A statement indicating grants released by the Ministry to State Governments towards Eklavya Model Residential Schools during the years 2005-06 and 2006-07 is enclosed. From the year 2007-08, no separate funds have been earmarked for EMRSs and the State Governments have been advised to accommodate their requirement for EMRSs within the amount released under Article 275(1) of the Constitution, as per the prescribed guidelines of the Ministry.

(c) : In order to promote education among tribal children, Ministry of Tribal Affairs also runs the following Schemes:

1) Scheme of Construction of Hostels for Girls and Boys.

2) Scheme of Establishment of Ashram Schools in Tribal Sub Plan Areas.

3) Scheme of Post Matric Scholarship to ST students.

4) Scheme of Upgradation of Merit.

5) Grants in-aid to Voluntary Organisations for Residential School, Non-Residential School and Hostel.

(a) & (b) : In so far as Ministry of Tribal Affairs is concerned, the details of the Schemes under which various facilities are provided to ST students regarding admission and tuition fees etc. in Government and Private institutions of different level of education is as follows:

1) Post Matric Scholarship to ST students:-

The value of Scholarship under the Scheme to eligible ST students includes maintenance allowance, provision for students with disabilities, re-imbursement of compulsory non-refundable fees, Study Tour charges, thesis typing/printing charges and book allowance for students pursuing correspondence courses for complete duration of course at specified rates for specified courses for different discipline. The details of beneficiaries under the scheme of Post Matric Scholarship, State-wise/Union Territory-wise during last three years is at Annexure.

2) Top Class Education:-

The Scheme of Top Class Education for ST Students has been introduced from the academic year 2007-08 with the objective of encouraging meritorious ST students for pursuing studies at degree and post degree level in any of the 127 identified institutes in both the Government and private sectors covering the field of management, medicine, engineering, law and commercial courses. Each institute has been allocated a maximum of five awards. Under the scheme, eligible ST students are awarded scholarship covering full tuition fee and other non-refundable dues in respect of Government/Government-funded institutions. However, there is a ceiling of Rs.2.00 lakh per annum per student for private sector institutions and Rs.3.72 lakh per annum per student for the private sector flying clubs for Commercial Pilot Training. In addition to the above, the scholarship also provides for living expenses, books and stationery grant, cost of a latest computer system along with its accessories as one time assistance during the course at specified rates. Under the scheme grants are released to the Institutes and not to States/Union Territories. During last financial 2007-08, grants have been sanctioned to 23 institutes for 79 numbers of students.

3) National Overseas Scholarship:-

The Scheme provides financial assistance to students selected for pursuing higher studies abroad in certain subjects at the Masters level, and for Ph. D and Post –Doctoral research programmes. Bachelor level courses in any discipline are not covered under the Scheme. Under the Scheme grants are released for fees, medical insurance premium, poll tax and visa fees at actual, maintenance allowance, annual contingency allowance at prescribed rates. During 2005-06 and 2006-07 no new students have gone abroad for pursuing higher studies. However during 2007-08, 2 new students have proceeded for higher studies abroad.

4) Rajiv Gandhi National Fellowship:-

In addition to these Schemes, under the Scheme of Rajiv Gandhi National Fellowship, financial assistance at par with UGC rates are provided to ST students for pursuing higher studies such as M.Phil and Ph.D. Under the Scheme grants are released to UGC and not to States/UTs. During 2005-06 and 2006-07 grants have been released for 400 and 376 ST students. During 2007-08 grants have been released to UGC for 667 anticipated candidates.

(a) & (b): To Improve the Quality of Science Education and to promote a scientific temper as envisaged in the National Policy on Education – 1986 as modified in 1992, a Centrally Sponsored Scheme for ‘Improvement of Science Education in Schools’ was stared from the year 1987-88. Under this scheme assistance was provided to the States/Union Territories for supply of science kits to upper primary Schools, setting up or up-gradation of science laboratories, library facilities in Secondary and Sr.Secondary Schools and training of Science and Mathematics teachers. Financial assistance was also provided to voluntary agencies for conducting experimental and innovative programmes in the field of Science Education.

( c): The erstwhile scheme of “Improvement of Science Education in Schools” which was one of the components of a composite scheme “Quality Improvement in Schools”, has been transferred to the State Sector w.e.f. 1.4.2006. Therefore, no proposals were processed in 2006-07 and 2007-08.

(d) to (f): In 1995, NCERT conducted an evaluation study to assess the impact of this scheme on the development of a scientific climate in schools and improvement of quality of teaching learning in science and mathematics. The report showed that the Scheme was extremely useful and had enormous potential to generate a scientific climate in the schools. During the Xth Plan the scheme was made part of a composite Scheme of “Quality Improvement in Schools”, with enhanced outlays. The scheme is at present in the State Sector.

(a): Yes, Sir, employment of children is allowed in non-hazardous occupations and processes.The Child Labour (Prohibition & Regulation) Act, 1986 prohibits employment of children below the age of 14 years in 15 Occupations and 57 Processes and it regulates the working conditions in non-hazardous industries where employment of children is not banned.

(b) & (c): The Hon’ble Supreme Court, in one of it’s directions had envisaged that working hours of children in non-hazardous occupations should not exceed six hours per day and education for at least two hours is ensured. The entire expenditure on education is to be borne by the concerned employer. In this regard the Government has issued suitable instructions to the State Governments, being Appropriate Government under the Act, to implement the guidelines of the Hon’ble Supreme Court. Status report on the implementation of the guidelines is being furnished to the Hon’ble Supreme Court from time to time.

(a) to (c): A Committee constituted by the Central Advisory Board of Education (CABE) under the chairmanship of Shri Kapil Sibal,the then Minister of State for Science & Technology and Ocean Development had submitted a report on 2.7.2005 containing essential provisions of the draft legislation envisaged under Article 21 A of the Constitution which seeks to make education a Fundamental Right for children in the age group of 6-14 years.The report was considered by the CABE on 14-15th July,2005.Based on the suggestions and comments received during the CABE meeting,a comprehensive draft Central Bill was circulated to the States/UTs in August,2005.However,based on further discussions by the High Level Group(HLG),constituted by the Prime Minister,a draft Model Right to Education Bill was prepared and circulated to the States/UTs for their comments.

Taking into consideration the concerns of the States/UTs and discussions in various forums/quarters,a decision was taken to enact a Central legislation on Right to Education. Accordingly, the draft Central Bill on Right to Education,2008 was circulated to the concerned Ministries/Departments of Government of India including Ministry of Law and Justice for inter-ministerial consultation.

“The Right of Children to Free and Compulsory Education Bill,2008” has been introduced in the Rajya Sabha on 15.12.2008.

The NCF-2005 emphasizes comprehensive health and physical education curriculum.NCF-2005 has been circulated to all the States/Union territories.It is for the States/Union Territories to develop their own curriculum and syllabus based on NCF.

(a): The Sarva Shiksha Abhiyan(SSA) programme is being implemented in all districts of the country to achieve the goal of universalisation of elementary education in a time bound manner, in a mission mode. Consequently since the launch of SSA all the out of school children in the 6-14 age group in the country (who numbered 320 lakh in 2001-02), have been brought in the ambit of elementary education except 75.97 lakh out-of-school children (as on 31.03.2007), who represent the difficult to reach category.

(b): Central Budget support of Rs. 10,671 Crore was provided in Budget Estimates 2007-08 for implementation of SSA. This was enhanced to Rs. 13,171 crore in the Revised Estimates 2007-08. An amount of Rs.11,336.38 crore has already been released to States/UTs as on 10.03.2008. Cumulative achievements made for key targets under SSA up to 31.12.2007 are given at Annexure.

(c) & (d): Under SSA programme 11.32 lakh teachers have been sanctioned up to 2007-08 against which 8.80 lakh teachers have been recruited till 31.12.2007. This has led to improvement in national average of Pupil Teacher Ratio (PTR) from 38:1 in 2005-06 to 36:1 in 2006-07 at primary level & from 34:1 to 32:1 at upper primary level in the corresponding period.

(a) & (b): Inspections and raids to detect cases of violation of Child Labour (Prohibition &Regulation) Act, 1986, are carried out from time to time by the State Governments who areappropriate authorities for enforcement of Act,in the areas that come under their jurisdiction.For the areas lying under the Central jurisdiction,inspections are carried out by the CentralLabour Commissioner's machinery. The information pertaining to inspections,violations,convictionsand prosecutions during 2006-07 as provided by the State Governments is at Annexure.

(c) & (d): Yes, Sir. Children are employed in agriculture and farming sector.However,employment ofchildren in agriculture is not prohibited under the Child Labour (Prohibition & Regulation) Act,1986 except in the processes where tractors, threshing and harvesting machines are used and chaffcutting is involved as also handling of insecticides and pesticides. For the rehabilitation ofChild Labour, Government is implementing the National Child Labour Project (NCLP) Scheme. Under the Scheme, children withdrawn from work are put into special schools, where they are providedwith accelerated bridging education, vocational training, nutrition, stipend and health carefacilities etc.

(c)&(d) As per information supplied by Bachpan Bacho Andolan, they have reported that there is a need for improving awareness on combating trafficking of children and rehabilitation and reintegration of the victims.

(b)&(e) The Ministry of Women and Child Development conducts advocacy, awareness generation and sensitization programmes for prevention of child trafficking. The Ministry of Women and Child Development also runs Swadhar Shelter Homes which provide shelter, food, clothing, emotional support, counseling, rehabilitation and other facilities to women in difficult circumstances including trafficked victims and children. The Ministry is also implementing a project to combat trafficking of women and children. The Immoral Traffic (Prevention) Act, 1956 (ITPA) supplemented by the Indian penal Code prohibits trafficking in women and children for purposes of prostitution and lays down severe penalties for traffickers. The ITPA is now being further amended providing for more stringent punishment for trafficking in persons.

(a) & (b): Under the Child Labour (Prohibition & Regulation) Act, 1986, Government has banned the employment of children as domestic workers/servants and in dhabas, restaurants, hotels, motels, tea-shops, spas and other recreational centres etc w.e.f. 10.10.06. Since then, 2229 violations have been detected in these two occupations during the inspections carried out by the State Governments, which are the appropriate Government for the enforcement of the Act.

(c): Child Labour is a manifestation of serious socio-economic problems, an effective enforcement of the ban requires widespread public awareness on the issue and a concerted strategy for the economic empowerment of the families of child labour. The Government has already undertaken extensive media campaign in this regard and has also addressed to the State/UT Governments for taking necessary measures. Consultations have also been held with the State Governments for finalizing State Action Plans for effective enforcement of the ban coupled with a rehabilitation plan for the children affected by it in convergence with the developmental schemes of various departments.

The Bonded Labour System (Abolition) Act, 1976 does not make any distinction between child bondage and adult bondage. Number of bonded labour liberated and rehabilitated from January 01, 2006 to 28th February, 2007 is 165. However, the Government is separately implementing the National Child Labour Project

(NCLP) Scheme for rehabilitating all working children withdrawn from hazardous occupations and processes. Under the Scheme, working children are identified through child labour survey, withdrawn from work and put into the special bridge schools, so as to provide them with enabling environment to join mainstream education system. In these Special Schools, besides formal education, they are provided stipend @ Rs. 100/- per month, Nutrition, Vocational Training and Health check-up.

(a): Yes, Sir. The Government is committed to complete elimination of child labour from the country. However, considering the nature and magnitude of the problem, a gradual and sequential approach is being followed, beginning with children working in hazardous occupations and processes and gradually covering children in non-hazardous occupations also.

(b): The National Child Labour Project Scheme is being implemented since 1988 for the rehabilitation of working children. Prior to 10th Plan, the scheme was being implemented in 100 districts. During the 10th Plan, the National Child Labour Project Scheme has been expanded to cover 250 districts in the country.

(c): The National Child Labour Project Scheme involves mainstreaming of working children into regular schools. Efforts are being made to economically empower the families of child labour by converging with various Income/Employment Generation Schemes of other Central Ministries and State Government Departments.

(d): An amount of Rs. 602/- crore has been allocated under the National Child Labour Project Scheme during 10th Plan Period for rehabilitation of working children.

(e): The Scheme is already under implementation.

(a) & (b): Government has noted the contents of the News item published in the Hindu on 22.11.2006. As such, Government is committed to elimination of child labour in phased manner beginning with those engaged in most hazardous occupations and processes first.

(c) & (d): Child Labour (Prohibition & Regulation) Act, 1986 prohibits employment of children in 15 occupations and 57 Processes and it regulates the working conditions in occupations which are not declared as hazardous. Sufficient deterrent provisions already exist in the Child Labour (Prohibition & Regulation) Act, 1986 for persons violating the provisions of the Act. The Act provides that any persons who employs any child in contravention of the provisions of the Act, is liable for punishment with imprisonment for a term which shall not be less than three months, but which may extend to one year or with fine, which shall not be less than Rs. 10,000/- but which may extend to Rs. 20,000/- or both. Instructions are issued, from time to time, to the State Governments who are the appropriate Government, for the strict enforcement of the same.

(a) & (b): As per the provisions of the Child Labour (Prohibition & Regulation) Act, 1986, children below the age of 14 years are prohibited from working in hazardous occupations and processes. At present, there are 15 occupations and 57 processes listed as hazardous under the Schedule to the Act, which includes Construction and Mines.

Elimination of child labour is an area of great concern and commitment for the Government of India. The problem of child labour is a socio-economic evil which is a direct consequence of poverty & illiteracy. Considering the magnitude and the nature of the problem, therefore, Government has adopted a gradual & sequential approach to withdraw and rehabilitate working children, beginning with those working in hazardous occupations/processes. Efforts are being made to withdraw children working in hazardous occupations and processes for their rehabilitation.

(c) to (e): There is no evidence to indicate that there is increase in child labour due to the new economy. Child labour is a socio-economic problem which is a direct consequence of poverty and illiteracy. Realizing the multifaceted and complex nature of this problem, Government had embarked on a holistic and multi-pronged programme to eliminate child labour from the country. The Government strategy, based on the National Policy on Child Labour announced in 1987, involves strong enforcement of the existing Act with simultaneous efforts towards rehabilitation of both parents and children through project based Action Plan and linkages with the poverty eradication and income generation programmes of the Government.

The Government of India initiated the National Child labour Project Scheme (NCLP) in 1988 to rehabilitate the working children starting with 9 Child Labour endemic districts of the country. The scheme has been progressively expanded to cover 250 districts of the country during the 10th Plan.

(f) & (g): As State Government are appropriate government for enforcement of Act in their respective areas, directions are regularly being given to them for strict enforcement, creating public awareness on the issue and for the effective implementation of the NCLP Scheme.

Overview of Recommendations under Formulation

School Education
Complexity of the issues involved in School Education and their regional diversity necessitate consultations on a scale wider than any other work done by NKC. A series of workshops were therefore held around the country, addressing issues of quantity, quality, management and access in school education. A wide range of stakeholders were involved in the consultations, including representatives from the government and bureaucracy, school administrators, teachers, personnel from DIETs and SCERTs, educationists, NGO/civil society organizations and private education providers. At the end of an executive process of discussion and consultation, some of the key areas of intervention that have emerged are:

(a)to(c): National University of Educational Planning and Administration (NUEPA) collects elementary school statistics annually through the District Information System for Education (DISE) from all districts in the country.According to DISE data 2006-07, 45.04 % students passed with 60% and above marks, at the exit classes of the primary stage.Girls have performed slightly better than boys,and the percentage of girls and boys passing with 60% and above marks is 45.12% and 44.96 % respectively.

State-wise percentage of boys and girls securing 60% and above marks in the examination at the end of Grade IV/V,as per District Information System (DISE) data 2006-07,is at Annexure.

Under Sarva Shiksha Abhiyan, several activities have been undertaken to improve the quality of elementary education.This includes recruitment of 8.32 lakh additional teachers to improve the pupil teacher ratio,in-service training of teachers for a period of 20 days every year,free distribution of textbooks for primary and upper primary classes to about 6.5 crore Scheduled Caste,Scheduled Tribe and girl students,academic support to primary and upper primary schools through 6395 Block Resource Centres and 68352 Cluster Resource Centres and regular evaluation of students.

The National Council of Educational Research and Training (NCERT) has made efforts to revamp the curriculum of school education,including primary education,in order to encourage creative thinking among children.This exercise carried out under the National Curriculum Framework(NCF),2005 has made a significant shift in school education towards a constructivist paradigm for teaching and learning.Suitable modifications have been made in development of textbooks,classroom transaction and learners` assessment.Based on the recommendations of NCF-2005 and Focus Group papers on different subjects,new syllabi have been developed.Subsequently the new textual material for classes I to V have been developed. These textbooks are child-friendly and provide space for creative thinking.The content of the textbooks is child centred which provide her/him space to explore and construct knowledge. It encourages children to move away from rote learning to creative learning.

The NCF-2005 views assessment at all levels,as a meaningful and comprehensive process pertaining to the quality and extent of a child`s learning,construction of knowledge and her/his interest attitudes towards learning,which may be manifested in various activities. (a) to (c): The Budget allocation of the Department of SchoolEducation & Literacy was increased by 21.18% in 2007-08 as compared to 2006-07. In the year 2008-09 budget for elementary education has gone up by 17.01% as compared to 2007-08, as per details given in Annexure.

(d): The percentage utilization of the Budget allocation of the Department in the year 2007-08 has been 99.83%.

(e) to (f): The Sarva Shiksha Abhiyan Programme provides for Universalisation of Elementary Education in a time bound manner to bridge all gender and social category gaps at elementary level and universal retention by 2010.

The Gross Enrolment Ratio (as per Selected Educational Statistics-2005-06 data) has been 109.40 at primary level and 71.15 at upper primary level. Girls enrolment has been 48% of total enrolment at primary level in 2006-07 and 46.5% at upper primary level. Out of school children have reduced from 3.20 crore in 2001- 02 to 0.76 crore as per State Reports, March, 2007. The Gross Enrolment Ratio for Girls has gone up to 105.87% in 2006-07 for primary and 66.50% for upper primary level.

(a) to (e): The Bonded Labour System (Abolition) Act, 1976 does not differentiate between child bondage and adult bondage. The estimation of the number of child labour in the country State-wise, is done on the basis of the census carried out by the Registrar General of India once every ten years. The last such Census was carried out in 2001. Therefore, yearly data regarding existence of child labour State-wise is not maintained. State-wise number of child labour population as per 2001 Census is at Annexure – I. The Central Government is implementing the National Child Labour Project (NCLP) Scheme for the rehabilitation of children withdrawn from work. Under the Scheme, grants are released directly to the Project Societies chaired by the Dist. Collector. State wise details of fund released during 2007-08 is at Annexure II. Regional and National work shops and meetings are held from time to time with participation of State Government and other stake holders. State Governments are the appropriate authority for enforcing the Child Labour (Prohibition & Regulation) Act, 1986 for the areas coming under their jurisdiction. In order to step up the enforcement activities, a fortnight long nation-wide awareness campaign on “Enforcement Drive against Child Labour” was launched by the Government on 14th November, 2007 under which, the State Governments were financially assisted for taking up awareness campaigns. Further, a Protocol on Prevention, Rescue, Repartriation and Rehabilitation of Trafficked & Migrant Child Labour has also been issued to the State Governments to facilitate the rescue and rehabilitation of such children.

(a): Yes, Sir, employment of children is allowed in non-hazardous occupations and processes.The Child Labour (Prohibition & Regulation) Act, 1986 prohibits employment of children below the age of 14 years in 15 Occupations and 57 Processes and it regulates the working conditions in non-hazardous industries where employment of children is not banned.

(b) & (c): The Hon’ble Supreme Court, in one of it’s directions had envisaged that working hours of children in non-hazardous occupations should not exceed six hours per day and education for at least two hours is ensured. The entire expenditure on education is to be borne by the concerned employer. In this regard the Government has issued suitable instructions to the State Governments, being Appropriate Government under the Act, to implement the guidelines of the Hon’ble Supreme Court. Status report on the implementation of the guidelines is being furnished to the Hon’ble Supreme Court from time to time.

Accordingly Government has set up a Working Group to examine these suggestions.

(a) & (b): The Government does not propose any fixed target date or time bound programme to abolish Child Labour since this problem emanates from other issues such as poverty and it is not possible to fix a specific period for its complete abolition. However, the Government is already implementing the National Child Labour Project Scheme for the elimination of child labour in 250 districts of 20 States of the country. Under the Scheme, children working in identified hazardous occupations and process are withdrawn from work and put in Special Schools where they are provided with accelerated education, vocational training, nutrition, stipend and healthcare facilities etc., before they are mainstreamed into regular education system.

(c) & (d): The ILO has supported child labour elimination efforts in the country through the IPEC (International Programme for the Elimination of Child Labour). However, the contribution of the ILO in terms of financial aid is not very high in comparison to Government of India allocation. The UNICEF also similarly contributes a very small amount for specific programmes of elimination of child labour. While these financial inputs have been helpful, it is the Government of India funding which is the primary source for combating child labour in the country.

(a) & (b): Inspections and raids to detect cases of violation of Child Labour (Prohibition &Regulation) Act, 1986, are carried out from time to time by the State Governments who areappropriate authorities for enforcement of Act,in the areas that come under their jurisdiction.For the areas lying under the Central jurisdiction,inspections are carried out by the CentralLabour Commissioner’s machinery. The information pertaining to inspections,violations,convictionsand prosecutions during 2006-07 as provided by the State Governments is at Annexure.

(c) & (d): Yes, Sir. Children are employed in agriculture and farming sector.However,employment ofchildren in agriculture is not prohibited under the Child Labour (Prohibition & Regulation) Act,1986 except in the processes where tractors, threshing and harvesting machines are used and chaffcutting is involved as also handling of insecticides and pesticides. For the rehabilitation ofChild Labour, Government is implementing the National Child Labour Project (NCLP) Scheme. Under the Scheme, children withdrawn from work are put into special schools, where they are providedwith accelerated bridging education, vocational training, nutrition, stipend and health carefacilities etc.

(a) to (c): While there is no specific proposal for social audit in export oriented industries, with a view to eliminating child labour from such industries, necessary steps are taken under the existing laws to prevent child labour in prohibited occupations and processes.

For the rehabilitation of Child Labour, Government is implementing the National Child Labour Project (NCLP) Scheme in 250 districts of the country which includes districts with high concentration of child labour in export oriented industries. Under the Scheme, Children withdrawn from work are admitted to Special Schools where they are provided with accelerated bridging education, vocational training, stipend, nutrition and health care facilities etc. Further, various export promotion councils have been requested to raise awareness campaigns as part of an action plan among their member-industries for the elimination of child labour.

(a) whether the Union Government has asked the State Governments and sought support from Non-Governmental Organisations (NGOs) in enforcing the ban on employment of children especially domestic servants and labourers in eateries particularly in tribal and scheduled caste dominated areas of the country;

(b) if so, the response of the State Governments and the NGOs thereto;

(c) whether the Government has formulated any scheme/project for rehabilitation of such liberated children due to the ban on child labour;

(d) if so, the details thereof alongwith the modus operandi to be followed;

(e) the funds allocated and released by the Union Government to NGOs during each` of the last three years and thereafter till date, State-wise and scheme/project- wise;

(f) the extent of success achieved by the NGOs during the said period, State-wise;

(g) whether the Union Government has received any complaint regarding misuse of funds by such NGOs;

(h) if so, the details thereof, State-wise, and NGO-wise; and

(i) the action taken/proposed to be taken by the Union Government in this regard?

(a) &(b): Yes, Sir. Government has prohibited employment of children as domestic servants andin dhabas, hotels, eateries etc. with effect from 10.10.2006. As State Governments are theappropriate authorities for implementation of the Child Labour (Prohibition & Regulation) Act,1986 in their respective areas, the State Governments have been advised to take all appropriatemeasures for the effective enforcement of this ban. In this connection, Government of India hasalso held consultations with the State Governments, NGOs and other stakeholders at Zonal levelall over the country for creating awareness generation and for developing of State action plansfor effective enforcement of the ban and rehabilitation of children withdrawn from theseoccupations.

(c) & (d): Government is implementing the National Child Labour Project (NCLP) Scheme in 250 districts of 20 states in the country for the rehabilitation of children withdrawn from work.Under the Scheme, children withdrawn from hazardous work are put into Special Schools, where they are provided with accelerated education, vocational training, nutrition, stipend and healthcare facilities etc. Most of the Special Schools under the Scheme are being run by the NGOs.

(e) & (f): Under NCLP Scheme, funds are not directly released to NGOs but to the DistrictCollector who is the Chairman of the District Project Society. However, Government is alsoimplementing the Scheme of Grants-in-aid to Voluntary Organisations in the Districts notcovered under NCLP Scheme. Detail s of Grants released to NGOs during the last three yearsunder the Scheme are at Annexure.

(g) to (i): `Complaints, if any, received in the ministry are forwarded to the respectiveState Governments for taking necessary action.

STATEMENT REFERRED TO IN REPLY TO LOK SABHA STARRED QUESTION NO. 155 FOR ANSWER ON 10.03.08 REGARDING FUND FOR VOCATIONAL TRAINING TO CHILD LABOURERS BY SHRI RAMDAS ATHAWALE

(a) For the rehabilitation of child labour, a Centrally Sponsored National Child Labour Project (NCLP) Scheme is being implemented in 250 Districts of the country. Under the Scheme, children withdrawn from hazardous occupations and processes are put into Special Schools, where they are provided with accelerated bridging education, vocational training, nutrition, stipend and health care facilities etc., so as to mainstream them into the regular education system. In addition, another project, namely INDUS Child Labour Project is being implemented in collaboration with the US Department of Labour since 2004 in 21 districts of the country. This project is being implemented through ILO.

Under these Schemes, composite allocations are made to the NCLP districts for all components, including Vocational Training. The State-wise and Year-wise details of the grants released under NCLP and INDUS schemes during Tenth Five Year Plan are given in Annexure-I.

(b) Government has proposed an amount of Rs. 3,738.91 crore for the NCLP Scheme in the Eleventh Five Year Plan, which also includes budget for vocational training. In the meantime, under NCLP Scheme, funds to the tune of Rs. 138.05 crore for 2007-08 and Rs. 144.06 crore for 2008-09 have been allocated. Under the Indus Project, funds to the tune of Rs.12 crore in 2007-08 and Rs.12 crore for 2008-09 have been allocated.

(c) During the Tenth Five Year Plan 2.71 lakh child labourers were mainstreamed into the regular education system under the NCLP Scheme. Under the INDUS Project, which started only in 2004, about 18,961 child labourers have been mainstreamed to regular education upto 2006-07. The State-wise details of children mainstreamed under NCLP and INDUS Project are at Annexure-II.
