Legal Intervention

The entire fight against child labour, bonded labour and trafficking is essentially a fight to uphold the criminal justice system. BBA believes that child labour, forced labour and trafficking are not just social ills but crimes against humanity and so must be treated as such.

All rescue operations of BBA are legal actions where all efforts are made towards maximising legal action against traffickers and employers.

BBA makes optimal use of laws of the land, the Constitutional Provisions and judicial directions in favour of the most deprived and marginalised sections of the Indian society, the children in particular. This is done through legal awareness, Public Interest Litigations, close cooperation with the legal fraternity, follow-up of important judgements and orders passed by the Honourable Courts. This has proven that if the law is properly used by the poor, it becomes the most powerful tool for social justice and the strongest means for their empowerment. BBA's legal intervention strategies have helped not only in attaining justice to the victims but also have brought the issue of child labour to the attention of the larger judicial and legal community.

Ashraf was rescued from domestic slavery when he was 8, in 1996. He was burnt and branded because he drank the leftover milk meant for his employer’s son. His plight was taken up by BBA and on BBA's petition, the National Human Rights Commission banned the employment of child domestic labour for government servants in 1999.

Subsequently, the Child Labour (Prohibition & Regulation) Act, 1986 was amended on 10 October 2006, to incorporate child domestic labour as a hazardous occupation thereby banning it.

After rehabilitation at Mukti Ashram, Ashraf completed his education and is now working in an automobile company. He is training to become a software programmer and he campaigns against child domestic labour in his free time.
